Forced Marriages in Islam

Hadith number 1

 

عن القاسم: أن امرأة من ولد جعفر، تخوفت أن يزوجها وليها وهي كارهة، فأرسلت إلى شيخين من الأنصار: عبد الرحمن ومجمع ابني جارية، قالا: فلا تخشين، فإن خنساء بنت خذام «أنكحها أبوها وهي كارهة، فرد النبي صلى الله عليه وسلم ذلك»

 

Narrated by al-Qāsim:

A woman from the offspring of Ja’far was afraid lest her guardian marry her (to somebody) against her will. So she sent for two elderly men from the Ansar, ‘AbdurRahmān and Mujammi’, the two sons of Jāriya, and they said to her, “Don’t be afraid, for Khansā’ bint Khizām was given by her father in marriage against her will, then the Prophet cancelled that marriage’

Hadith number 2

 

عن خنساء بنت خذام الأنصارية: أن أباها زوجها وهي ثيب فكرهت ذلك «فأتت النبي صلى الله عليه وسلم فرد نكاحها»

 

Narrated by Khansā’ b. Khizām al-Ansāriya:

‘That her father gave her in marriage when she was a matron and she disliked that marriage. So she came and (complained) to the Prophet (sall Allāhu `alayhi wa sallam) and he declared that marriage invalid’

Hadith number 3

 

عن أبي هريرة، عن النبي صلى الله عليه وسلم، قال: «لا تنكح البكر حتى تستأذن، ولا الثيب حتى تستأمر» فقيل: يا رسول الله، كيف إذنها؟ قال: «إذا سكتت»

 

Narrated by Abū Huraira:

‘The Prophet (sall Allāhu `alayhi wa sallam) said, “A virgin should not be married till she is asked for her consent; and the matron should not be married till she is asked whether she agrees to marry or not.” It was asked, “O Allāh’s Apostle! How will she (the virgin) express her consent?” He said, “By keeping silent’

Hadith number 4

 

عن ابن عباس، أن جارية بكرا أتت النبي صلى الله عليه وسلم، فذكرت له أن «أباها زوجها وهي كارهة، فخيرها النبي صلى الله عليه وسلم»

 

Ibn ‘Abbās Narrated:

 ‘A virgin came to Prophet (sall Allāhu `alayhi wa sallam) and told him that her father had arranged a marriage that she did not like, and the Prophet gave her the choice (to cancel it)’

 

(Abū Dāwúd in al-Sunan, Ibn Majah in al-Sunan, Ahmad in al-Musnad)

 

Hadith number 5

 

عن ابن بريدة، عن أبيه، قال: جاءت فتاة إلى النبي صلى الله عليه وسلم، فقالت: ” إن أبي زوجني ابن أخيه، ليرفع بي خسيسته، قال: فجعل الأمر إليها، فقالت: قد أجزت ما صنع أبي، ولكن أردت أن تعلم النساء أن ليس إلى الآباء من الأمر شيء

 

Narrated by Ibn Buraydah that his father said:

‘A girl came to the Prophet (sall Allāhu alayhi wa sallam) and Said: my father married me to his brother's son so that he might raise his status thereby. The Prophet (sall Allāhualayhi wa sallam) gave her choice (to have this marriage or to cancel it). She Said: I approve of what my father did, But I wanted women to know that their fathers have no right to do that (Forced marriages)’

Hadith number 6

 

عن جابر، أن رجلا، زوج ابنته وهي بكر من غير أمرها، فأتت النبي صلى الله عليه وسلم «ففرق بينهما

 

Narrated By Jābir:

‘A man married her daughter against her will, when the reports came to Prophet (sall Allāhu `alayhi wa sallam) he cancelled this marriage’

 

(Nasā’ī in al-Sunan, Dārqutnī in al-Sunan, Bayhaqī in al-Sunan)

 

Hadith number 7

 

عن أبي سلمة، قال: «أنكح رجل من بني المنذر ابنته، وهي كارهة فأتى النبي صلى الله عليه وسلم» فرد نكاحها

 

Narrated by Abū Salamah:

‘A man from Banī al-Mundhar married her daughter against her will, when this reports come to Prophet (sall Allāhu `alayhi wa sallam) he cancelled this marriage’
